Overview

WeThryv is a market intelligence and marketing workflow platform. This Privacy Policy (the "Policy") describes how we collect, use, disclose, and protect information on our public website at wethryv.com.au (the "Marketing Site") and within our software-as-a-service product at app.wethryv.com.au (the "Application"). By accessing or using the Marketing Site or Application (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by this Policy.

Information We Collect

1) Information You Provide Directly

  • Account & Contact Information. When you create an account, sign up for our waitlist, newsletter, or free trial, or submit any form on the Services, we collect identifiers such as your name, email address, phone number (if provided), company name, job title, and any other information you voluntarily provide.
  • Newsletter and Marketing Consent. By submitting your email address through any form, waitlist signup, trial registration, or other submission mechanism on the Services, you expressly consent to receive newsletters, product updates, feature announcements, promotional offers, and other marketing communications from WeThryv. You may unsubscribe at any time via the unsubscribe link included in such communications or by contacting us directly.
  • Business Profile & Project Data. Information you enter into the Application regarding your industry, target market, products, services, brand voice, audience segments, positioning, competitive landscape, and any related business intelligence you provide to enable the Services.
  • User Content & Prompts. Text, files, briefs, keywords, search queries, persona descriptions, campaign parameters, or other content you input, upload, or generate through the Application's features, including but not limited to insight generation, copy creation, and analysis tools.
  • Payment Information. If you purchase a subscription, our third-party payment processor collects billing details (credit/debit card information, billing address). We do not directly store complete payment card details on our servers.
  • Communications & Support. Information you provide when you contact us for support, participate in surveys, provide feedback, or otherwise communicate with us via email, chat, tickets, or other channels.

2) Information Collected Automatically

  • Usage Data & Analytics. We automatically collect information about your interactions with the Services, including but not limited to: pages and features accessed, time spent on pages, click paths, session duration, scroll depth, buttons clicked, features utilized, frequency and timing of use, search queries within the Application, and performance metrics.
  • Device & Technical Information. Device type, operating system, browser type and version, screen resolution, IP address (which may indicate general geographic location), unique device identifiers, mobile network information, and referring/exit URLs.
  • Cookies & Similar Technologies. We use cookies, web beacons, local storage, session tokens, and similar tracking technologies to: (i) authenticate users and maintain session state; (ii) remember user preferences and settings; (iii) analyze usage patterns and measure marketing campaign effectiveness; (iv) deliver personalized content and advertising; and (v) detect and prevent fraud or abuse.   • Third-Party Analytics & Advertising. We use third-party services including but not limited to Google Analytics, Facebook Pixel, and PostHog to collect and analyze usage data, measure advertising performance, and build custom audiences for targeted marketing. These services may collect information about your activities across different websites and services over time.

3) Information from Publicly Available Sources

To power our market intelligence features, the Application may collect, scrape, index, and analyze publicly available content from online sources including but not limited to forums, review sites, social media platforms, community discussions, and other publicly accessible websites. This analysis is performed in accordance with applicable laws, terms of service, and robots.txt protocols. We use reasonable technical, administrative, and policy safeguards to ensure compliance with legal requirements. The resulting insights are provided to our users as part of the Services. If you believe your publicly available content has been included in our analysis and you wish to request its exclusion, please contact us using the information provided below.

How We Use Information

We use the information we collect for the following purposes, which constitute our legitimate business interests and, where applicable, are based on your consent:

  • Provide and Operate the Services. To create and manage user accounts, authenticate access, process transactions, deliver requested features (including insight generation, copy creation, and analysis tools), respond to support requests, and otherwise operate, maintain, and provide the functionality of the Services.
  • Product Development and Improvement. To analyze usage patterns, diagnose technical issues, evaluate feature performance, conduct research and development, test new features, enhance user experience, improve the accuracy and quality of our algorithms and outputs, and otherwise develop, refine, and optimize the Services. This includes using aggregated, de-identified, or anonymized data for internal analytics and product improvement.
  • Marketing and Communications. To send you newsletters, product announcements, feature updates, educational content, promotional offers, surveys, and other marketing communications related to WeThryv. By providing your email address or contact information to us through any means (including forms, signups, waitlists, or trials), you expressly consent to receive such marketing communications. Information collected may be used to personalize marketing messages, measure campaign effectiveness, build targeted advertising audiences, and conduct market research. You may opt out of marketing emails at any time using the unsubscribe link or by contacting us.
  • Advertising and Retargeting. To deliver targeted advertisements on third-party platforms (including but not limited to Facebook, Google, and LinkedIn), create custom and lookalike audiences based on user behavior and characteristics, measure advertising performance and return on investment, and conduct A/B testing of marketing messages and creatives.
  • Analytics and Performance Measurement. To understand how users interact with the Services, measure engagement, track conversions, analyze traffic sources, evaluate marketing campaign performance, and generate business intelligence reports.
  • Security, Fraud Prevention, and Compliance. To detect, investigate, and prevent fraudulent transactions, unauthorized access, abuse of the Services, violations of our Terms of Service, and other malicious or illegal activities; to protect the rights, property, and safety of WeThryv, our users, and the public; and to enforce our agreements and policies.
  • Legal Obligations. To comply with applicable laws, regulations, legal processes, or governmental requests; respond to subpoenas, court orders, or other lawful demands; establish, exercise, or defend legal claims; and otherwise fulfill our legal obligations.

Important: Your information is used exclusively for the purposes stated above and is not sold, rented, leased, or otherwise disclosed to third parties for their independent commercial purposes. We retain full control over how your data is used and do not permit third parties to use your information for purposes outside of providing services to us as described in "How We Share Information" below.

Artificial Intelligence and Third-Party Processing

Certain features of the Application utilize third-party artificial intelligence and machine learning infrastructure to process user inputs and generate outputs (including but not limited to text analysis, insight generation, copy creation, and pattern recognition). When you use such features, your inputs may be transmitted to and processed by these third-party AI service providers. We enter into written agreements with such providers that contractually obligate them to: (i) process data solely for the purpose of providing services to us; (ii) maintain appropriate security safeguards; (iii) refrain from using your content to train models for other customers or for their own purposes; and (iv) comply with applicable data protection laws. Notwithstanding such contractual restrictions, you acknowledge that AI processing involves inherent risks, and you use AI-powered features at your own discretion. We do not sell, license, or transfer your content to AI providers for purposes other than delivering the Services to you.

How We Share Information

We do not sell, rent, trade, or otherwise disclose your personal information to third parties for their own marketing, advertising, or commercial purposes. We may share information in the following limited circumstances:

  • Service Providers and Processors. We engage trusted third-party vendors, contractors, and service providers to perform functions on our behalf, including but not limited to: cloud hosting and infrastructure (e.g., AWS, Vercel, DigitalOcean); email delivery and marketing automation (e.g., SMTP providers, email service providers); analytics and monitoring (e.g., Google Analytics, PostHog); advertising and marketing platforms (e.g., Facebook, Google Ads, LinkedIn); payment processing (e.g., Stripe, PayPal); customer support tools; AI and machine learning infrastructure; and security services. These parties access information only to the extent necessary to perform their designated functions and are contractually obligated to maintain confidentiality and security, use the information solely for providing services to us, and comply with this Policy and applicable law.
  • At Your Direction or with Your Consent. If you explicitly authorize or instruct us to share information with third parties (e.g., by connecting third-party integrations, requesting data exports, or granting permissions to external tools), we will do so in accordance with your instructions.
  • Legal Obligations and Protection of Rights. We may disclose information where we believe in good faith that such disclosure is necessary to: (i) comply with applicable laws, regulations, legal processes, or enforceable governmental requests (including but not limited to subpoenas, court orders, or regulatory inquiries); (ii) enforce or investigate potential violations of our Terms of Service, Acceptable Use Policy, or other agreements; (iii) detect, prevent, or address fraud, security issues, or technical problems; (iv) protect the rights, property, safety, or security of WeThryv, our users, or the public as required or permitted by law; or (v) defend against legal claims or liability.
  • Business Transfers and Corporate Transactions. In the event of a merger, acquisition, reorganization, bankruptcy, dissolution, sale of assets, or other corporate transaction or proceeding involving WeThryv, personal information may be transferred, sold, or assigned to a successor entity or third party acquirer. In such event, we will require the recipient to honor this Policy or provide you with notice and, where required by law, obtain your consent to any material changes in how your information is used.
  • Aggregated and De-Identified Information. We may share aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you (e.g., statistical summaries, industry benchmarks, usage trends) with third parties for research, marketing, analytics, or other purposes without restriction.

International Transfers

WeThryv operates globally, and information we collect may be transferred to, stored in, and processed in countries other than the country in which you reside, including but not limited to Australia, the United States, and other jurisdictions where our service providers operate. These countries may have data protection laws that differ from the laws of your jurisdiction. Where we transfer personal information from the European Economic Area, United Kingdom, Switzerland, or other jurisdictions with data transfer restrictions to countries that have not been deemed to provide an adequate level of protection, we implement appropriate safeguards such as Standard Contractual Clauses approved by the European Commission or other legally recognized transfer mechanisms. By using the Services, you acknowledge and consent to such international transfers and processing.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. Retention periods vary depending on the type of information and the purpose for which it was collected. Specifically:

  • Account Information: Retained for the duration of your active account and for a reasonable period thereafter (typically 90 days after account deletion) to accommodate account reactivation requests, resolve disputes, and comply with legal obligations.
  • Marketing and Newsletter Data: Retained until you unsubscribe or request deletion, plus a reasonable period to honor your opt-out preferences and prevent re-addition.
  • Usage and Analytics Data: Retained for up to 36 months or as required by our analytics service providers' data retention policies.
  • Business Profile and User Content: Retained for the duration of your subscription and for up to 90 days following cancellation, unless you request earlier deletion.
  • Legal and Compliance Records: Retained as required by applicable law, regulation, or legal hold (e.g., tax records, transaction logs, communications related to disputes).

When we no longer need information, we will securely delete or anonymize it. You may request deletion of your personal information at any time by contacting us (see "Your Rights & Choices" below), subject to our legal obligations and legitimate business needs.

Security

We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures include but are not limited to:

  • Encryption of data in transit using industry-standard protocols (e.g., TLS/SSL);
  • Encryption of sensitive data at rest where appropriate;
  • Access controls and authentication mechanisms to limit access to authorized personnel only;
  • Regular security assessments, monitoring, and logging of system activities;
  • Employee training on data protection and security best practices;
  • Incident response and breach notification procedures;
  • Secure development practices and code reviews.

However, no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information using commercially reasonable means, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. Please use a strong, unique password and notify us immediately if you suspect unauthorized access to your account.

Your Rights & Choices

Newsletter and Marketing Opt-Out

You may opt out of receiving marketing communications from us at any time by: (i) clicking the "unsubscribe" link at the bottom of any marketing email; (ii) adjusting your communication preferences in your account settings (if available); or (iii) contacting us directly at the email address provided below. Please note that even if you opt out of marketing communications, we may still send you transactional, service-related, or administrative messages that are necessary for the operation of your account and the Services (e.g., password resets, billing notices, security alerts, terms updates).

Cookies & Tracking Technologies Choices

Most web browsers are set to accept cookies by default. You can configure your browser settings to refuse cookies, delete existing cookies, or alert you when cookies are being sent. However, please note that:

  • Essential Cookies: Some cookies are strictly necessary for the Services to function (e.g., session management, authentication, security). Disabling these cookies will impair or prevent your ability to use the Services.
  • Analytics and Advertising Cookies: You may opt out of certain analytics and advertising cookies using browser settings, privacy browser extensions, or industry opt-out tools such as the Network Advertising Initiative opt-out page or the Digital Advertising Alliance opt-out page.
  • Do Not Track: Some browsers support "Do Not Track" (DNT) signals. Our Services do not currently respond to DNT signals, but you may use the cookie management options described above.

Children's Privacy

The Services are not intended for, directed to, or designed to attract individuals under the age of sixteen (16) years. We do not knowingly collect, use, or disclose personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16 without verified parental consent, we will take reasonable steps to delete such information as promptly as possible. If you believe we have collected information from a child under 16, please contact us immediately.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with specific rights regarding your personal information. These rights include the right to know what personal information we collect, the right to delete personal information, the right to opt-out of the "sale" or "sharing" of personal information for cross-context behavioral advertising, and the right to non-discrimination for exercising your rights. WeThryv does not sell personal information as defined by the CCPA. We may share information with advertising partners for targeted advertising purposes, which may constitute "sharing" under CCPA. Australian Privacy Principles

WeThryv is committed to complying with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). Australian residents have rights to access and correct their personal information, make complaints about privacy breaches, and request that we cease sending marketing communications. To exercise these rights or make a privacy complaint, please contact us using the details below. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Changes to this Policy

We reserve the right to modify, amend, or update this Privacy Policy at any time to reflect changes in our practices, legal requirements, or business operations. When we make material changes, we will update the "Last updated" date at the top of this page and, where required by law or appropriate under the circumstances, provide additional notice (such as by email notification to registered users, a prominent notice on the Marketing Site, or an in-app notification).
